Terms and Conditions

Last updated on 07/09/2026.

Article 1 — Who we are

MCK Group Srl, with its registered office at Textiellaan 11, 7700 Mouscron, Belgium, company number 0804.971.029, VAT number BE0804.971.029, e-mail info@mckracing.be, telephone +32 492 25 16 16. Referred to below as "MCK" or "we".

Article 2 — Scope

These terms apply to every visit to our website and to every contract you conclude with us, unless we have agreed otherwise in writing. By placing an order or confirming a booking, you accept them.

Some articles apply only to consumers, meaning natural persons acting outside their professional activity. Others apply only to businesses. Where that is the case, it is stated expressly. Mandatory statutory provisions in favour of the consumer always take precedence over these terms.

In relation to businesses we do not accept the application of their own terms, unless we agree to this in writing.

Article 3 — Offer and prices

Our prices are expressed in euro. They include VAT for consumers and exclude VAT for businesses, unless stated otherwise. Delivery, transport and administrative costs are stated separately before your order becomes final.

The offer on the website applies while stocks last and for as long as it is online. Obvious errors or material mistakes in prices or descriptions do not bind us.

Article 4 — Formation of the contract

The contract is formed as soon as we confirm your order, booking or instruction in writing or by e-mail. Commitments made by our staff bind us only after that confirmation.

Article 5 — Delivery and performance

Stated periods are indicative, unless we have expressly confirmed them as binding. In relation to consumers we deliver no later than thirty days after the contract is concluded, unless agreed otherwise. If delivery fails to take place, the consumer may grant us an additional reasonable period and, if that period also passes, terminate the contract and recover the amounts paid.

For consumers, the risk of loss or damage passes only when they physically take possession of the goods.

Article 6 — Payment by businesses

Our invoices are payable in Mouscron, without discount, within thirty days of the invoice date.

If payment is not made by the due date, interest of 1.5 % per month is due by operation of law and without notice of default, together with fixed compensation of 20 % of the invoice amount with a minimum of 75 euro. Where we ourselves fail to meet our obligations, the same compensation is due from us on the same conditions.

Failure to pay one invoice on its due date renders all our claims immediately payable and entitles us to suspend performance of ongoing contracts.

Article 7 — Payment by consumers

If a consumer does not pay on time, we first send a free reminder. It states the outstanding amount, the compensation that will become due thereafter, and the period in which payment can still be made. Only after a period of fourteen calendar days has passed, running from the third working day after that reminder is sent, or from the calendar day after sending where it is sent electronically, can we charge any compensation.

That compensation amounts to a maximum of 20 euro where the outstanding balance does not exceed 150 euro; 30 euro plus 10 % of the amount in the band between 150.01 and 500 euro; and 65 euro plus 5 % of the amount in the band above 500 euro, with an absolute maximum of 2,000 euro. Late payment interest does not exceed the reference rate under the Belgian Act of 2 August 2002 on late payment in commercial transactions, increased by eight percentage points.

Where we ourselves fail to meet our obligations, the consumer is entitled to equivalent compensation on the same conditions.

Article 8 — Cancellation

If a business cancels a confirmed instruction, compensation of 20 % of the value excluding VAT of the unperformed services is due. If we cancel ourselves without valid reason, the same compensation is due from us.

For consumers, cancellation of a training day, test day or booking is governed as follows: free of charge up to 7 days before the start, after which 100 % is charged. The same arrangement applies to our detriment where we cancel for a reason other than force majeure.

Article 9 — Participation in driving activities

Anyone taking part in a training session, track day, race or Drive for Fun activity follows the instructions of our staff and of the circuit organisation, wears the prescribed safety equipment and is fit to drive safely. Participation under the influence of alcohol, drugs or medication affecting driving ability is not permitted.

Minors take part with the written consent of a parent or guardian. Where the organiser or federation requires a licence or insurance, it is the participant's responsibility to hold it.

We may exclude a participant who endangers their own safety or that of others, or who does not follow instructions, without any right to a refund.

Article 10 — Liability

Our liability is limited to direct damage resulting from our fault and never exceeds the amounts covered by our insurer in the case concerned.

We never exclude our liability for intent, for gross negligence, or for damage to life or physical integrity resulting from a fault on our part or on the part of our staff.

Motorsport carries risks inherent to the activity. We are not liable for damage arising from those risks where no fault can be attributed to us.

Article 11 — Force majeure

If we cannot perform our obligations due to an event beyond our control, such as a supply interruption, a strike, extreme weather or the cancellation of an event by the organiser, our obligations are suspended for as long as that situation lasts. If it lasts longer than 30 days, either party may terminate the contract free of charge.

Article 12 — Intellectual property

The texts, photographs, videos, logos and design on this website are protected. You may not copy, distribute or reuse them without our prior written consent, except for strictly personal use.

Article 13 — Personal data

How we handle your personal data is set out in our privacy policy and our cookie policy.

Article 14 — Complaints

If you have a complaint, please tell us first at info@mckracing.be; we are glad to look for a solution with you. If no agreement is reached, a consumer can turn free of charge to the Belgian Consumer Mediation Service, Koning Albert II-laan 8 box 1, 1000 Brussels.

Article 15 — Severability

If a provision of these terms is void or unenforceable, the remaining provisions remain fully in force. The void provision is replaced by a valid provision that comes as close as possible to the intended purpose.

Article 16 — Governing law and jurisdiction

Our contracts are governed by Belgian law.

Disputes with businesses are settled exclusively by the courts of the judicial district of Hainaut, Tournai division. Disputes with consumers are brought before the court designated by law, as a rule that of the consumer's domicile.
